The Department has made a Statutory Rule entitled “The Planning (Control of Advertisements) (Amendment) Regulations (Northern Ireland) 2014 (S.R. 2014 No.118)”, which comes into operation on 23rd April 2014. The Statutory Rule amends the Planning (Control of Advertisements) Regulations (Northern Ireland) 1992 (S.R. 1992 No. 448) to remove the exemption from control for advertisements relating specifically to a pending Parliamentary, European Parliamentary, Assembly or district council election and to provide deemed consent for the display of such advertisements. This means that these advertisements can be lawfully displayed, without the need to apply for and obtain the Department’s express consent, except in areas where a direction is in force removing deemed consent.
The Department of the Environment has also made a Direction under regulation 6 of the 1992 Regulations. The effect of the Direction is that during the period from 8th – 11th May 2014 the Department’s express consent under regulation 4 of the Planning (Control of Advertisements) Regulations (Northern Ireland) 1992 is required for the display of advertisements in Class 13 (Advertisements relating to an election) of Part 1 of Schedule 3 to the Regulations along the route of the Giro d’Italia.
