Belfast Metropolitan Area Plan 2015: Determination as to the feasibility of carrying out an Environmental Assessment

The Department of the Environment for Northern Ireland (the Department) has conducted a review of its decision to carry out an Environmental Assessment of the draft Belfast Metropolitan Area Plan 2015 (including Plan Amendment No. 1).
Environmental assessments have been carried out for a number of Area Plans under the Environmental Assessment of Plans and Programmes (Northern Ireland) Regulations 2004 (the SEA Regulations) and Directive 2001/42/EC of the European Parliament on the assessment of the effects of certain plans and programmes on the environment (the SEA Directive). The environmental assessments for the Northern, Magherafelt and Banbridge Newry & Mourne Area Plans were the subject of judicial review challenges.
In light of these challenges, the Department has conducted a review of its decision to carry out an environmental assessment of the draft Belfast Metropolitan Area Plan 2015 (including Plan Amendment No. 1) under the terms of the SEA Directive and the SEA Regulations. As a result of this review, the Minister for the Environment has now determined that it was not feasible to carry out an environmental assessment of the draft Belfast Metropolitan Area Plan 2015 (including Plan Amendment No. 1) in accordance with the SEA Directive and the SEA Regulations.
