Consultation Paper on The Draft Planning (Hazardous Substances) (Amendment)  Regulations (Northern Ireland) 2014
The Department of the Environment has today issued a consultation paper on its proposals for amendment of the Planning (Hazardous Substances) Regulations (Northern Ireland) 1993 (the Hazardous Substances Regulations).
The purpose of the consultation is to obtain views on the specific amendment to the Hazardous Substances Regulations described within the paper.
The Hazardous Substances Regulations apply the Seveso II Directive (Directive 96/82/EC, as amended), to the planning process in Northern Ireland. The Seveso II Directive requires that the objectives of preventing major-accidents involving dangerous substances are taken into account in land use planning policies. The Seveso II Directive is being amended by Article 30 of the Seveso III Directive from 14th February 2014, which adds heavy fuel oils (HFO) as a specific named substance in Annex 1 with a threshold of 2,500 tonnes.
The draft Regulations will amend the Hazardous Substances Regulations to give effect to Article 30 of the Seveso III Directive, by adding “d) heavy fuel oils” to the heading “Petroleum products” in the table in part A of Schedule 3 with a controlled quantity of 2,500 tonnes.
Comments on the Equality Impact Assessment Screening document and Partial Regulatory Impact Assessment which are contained in the paper are also welcome.
The closing date for the receipt of comments is 20th January 2014.
