Policy CTY 5: Justification & Amplification Replacement of Tenanted Dwelling Houses
4.50 The assessment of whether an existing dwelling is currently occupied will usually be self-evident and not require further scrutiny, save only to clarify the tenancy arrangements of the present occupant. It will not normally be possible to approve an application for replacement of an existing house that is tenanted. This is because almost all tenanted dwellings in NI are subject to legislation that limits the rights of landlords to gain possession and occupation.
4.51 All permissions for a replacement dwelling granted under this policy will be subject to a condition requiring demolition of the existing dwelling or restricting its future use if it is to be retained as part of the overall development scheme.
