A Co. Fermanagh man was fined £20,000 at Enniskillen Magistrates' Court today for non compliance with a Planning Enforcement Notice which sought the demolition of an unauthorised dwelling at Derryclawan, Lisbellaw.
Mr Adrian John Orr, Derryclawan Road, Derryclawan, Lisbellaw appealed the enforcement notice but it was upheld by the PAC in a decision dated the 6 April 2011.

This is the second fine imposed on Mr Orr in relation to this unauthorised dwelling. On the 14 September 2011, the same magistrate as today imposed a fine of £3,000 plus £85 court and legal costs.

Mr Orr was convicted under Article 72 of the Planning (NI) Order 1991, as amended, as it is an offence to be in breach of an enforcement notice.

A breach of a notice occurs where, at any time after the period for compliance has lapsed, any step required to be taken has not been taken.

Enforcement action will continue until the matter is resolved.
