Unauthorised Gas Bottling Plant demolished

Mr Francis Wray and Mrs Noleen Wray of Scotstown Road, Clady were today fined £250 each at Strabane Magistrates’ Court for further non-compliance with an enforcement notice.
Mr and Mrs Wray were charged with the unauthorised erection of shed, tanks and yard in use as a gas bottling plant at 3 Scotstown Road, Clady, Co Tyrone. They are also required to pay legal costs of £75.00 each and court costs of £26.00 each. This is in addition to a £7,000 fine imposed on the appellants for the same offence on the 5th May 2009.
The gas bottling plant had to be demolished after the Planning Appeals Commission upheld the enforcement notice seeking its removal.This was complied with during the week beginning the 8th February 2010.
Planning Service brought the action under Article 67A(1)(a) of the Planning (NI) Order 1991 (as amended) for the carrying out of development without the planning permission required.

Notes to editors:
1. Mr and Mrs Wray appealed the penalties initially imposed on them at Strabane Magistrates Court on 12 March 2009.
2. The appeal was heard at Strabane County Court on 5 May 2009. A distinction between Mr and Mrs Wray was made resulting in the fine for Mrs Wray being reduced form £3,500 to £1,000. However, the fine imposed on Mr Wray was increased from £5000 to £6,000.
