Strategic Environmental Assessment Judicial Reviews
Seaport Investments applied for a Judicial Review of the Strategic Environmental Assessment (SEA) of the Draft Northern Area Plan (DNAP) 2016. Leave was granted for the DNAP Judicial Review in January 2006, and the hearing took place from 28th November to 1st December 2006. A similar application was made by Magherafelt District Council, FP McCann (Developments) Ltd and Others against the SEA that accompanied the Draft Magherafelt Area Plan (DMAP) 2015. This case was heard on 25th and 26th January 2007. Leave was also granted for a Judicial Review into the SEA of the Draft Banbridge, Newry and Mourne Area Plan 2015 in November 2006 by the Murdoch Group Limited. This case is adjourned pending the outcome of the Judicial Reviews into the SEAs which accompanied DNAP and DMAP.
Mr Justice Weatherup’s judgement in respect of the challenges against the Strategic Environmental Assessments for both the Draft Northern and Magherafelt Area Plans was handed down in the High Court on Friday 7th September 2007 and ruled largely in favour of the applicant.
Planning Service is now carefully considering the judgement and its implications in consultation with legal advisors. A remedies hearing is scheduled to take place in November 2007.
In the interim, Planning Service has decided to hold all decisions on those applications which would be determined under the three draft Area Plans.
