Can I submit a repeat application for the same site?

6. The Department may decline to determine an application for planning permission if the proposal is the same or substantially the same as a previous planning application, for the same site which, within a period of 2 years, has been refused under Article 31 of the Planning (NI) Order 1991, or has been dismissed on appeal to the Planning Appeals Commission.
