Understanding Planning Legislation: 'The 1991 Order'

The 1991 Order is primary legislation, known in the UK as an Order in Council.
It is, if you like, the parent legislation and creates the Northern Ireland planning system. It enables the provision of subordinate legislation which provides for the detailed operation of the planning system. It gives the Department the power to carry out many functions, such as:

- the production of planning policies,
- the preparation and adoption of development plans,
- the determination of planning applications and applications for consent,
- designation of and control of demolition in conservation areas,
- taking enforcement action against breaches of planning control,
- protection of trees and so on.
Planning Control and Development
If the planning system were to require a planning application or application for consent in relation to every type of development as defined under the 1991 Order it would grind to a halt. The 1991 Order enables the Department to avoid this in a number of ways:
