The Planning (Use Classes) Order (Northern Ireland) 2004
The Planning (Use Classes) Order (Northern Ireland) 2004 is an order made under Article 11 (2) (e) of the Planning (Northern Ireland) Order 1991 and provides that a change of use is not development where the former use and the new use are both within the same class as set out in the Schedule to the Order. In addition, paragraph (4) of Article 3 of this Order excludes from the Schedule, uses specified in that paragraph, so that those uses always require planning permission.
