Primary Legislation

The Planning (Northern Ireland) Order 1991 ("the 1991 Order") places a general duty on the Department to formulate and co-ordinate policy for securing the orderly and consistent development of land and the planning of that development.
The 1991 Order also gives the Department various powers to enable it to carry out these duties which include the granting of planning permission, the preparation of development plans and enforcement of development control. These powers were extended by the Planning (Amendment) (Northern Ireland) Order 2003, which introduced new and revised powers and penalties.
Further amendments and additional powers were included in the Planning Reform (Northern Ireland) Order 2006. This Order introduced a number of new measures relating to the Department's development control, enforcement and development plan functions, including commitments made in the Modernising Planning Processes Implementation Plan. It also ended the Crown's immunity from planning control.
The Planning Act (Northern Ireland) 2011, which received Royal Assent on 4 May 2011, provides the legislative basis to radically reform the planning system and for the transfer of planning powers to district councils at a time and in circumstances to be agreed by the Executive.
