Benchmarking of Planning Enforcement Reports
Consultants were appointed in July 2003 to benchmark planning
enforcement in Northern Ireland against a number of planning
authorities in GB.
The aims of this project were to enable Planning
Service to:
-
identify best practice methods of dealing with
breaches of planning control; and,
-
to investigate the options for dealing with
development without planning permission, including the case for
criminalisation.
A three part report has been produced covering:
-
Benchmarking of Planning Enforcement – this part
considers how planning enforcement in Northern Ireland operates
and performs in comparison with other GB authorities and makes
recommendations for change, a number of which have already been
implemented;

Options for addressing the commencement of
development without planning permission – this part examines the
current criminalisation position in the Republic of Ireland,
presents and considers five options for addressing development
commenced without planning permission in Northern Ireland, and
following consideration of each, identifies a preferred option;

Appendix 1:

A partial regulatory impact assessment of the
preferred option, i.e. review the need for a criminal offence
for commencing development without planning permission at a
later date when the Benchmarking recommendations have been
implemented.

In light of this report, the Minister, Jeff Rooker,
has decided that the case for criminalisation will be considered
again once the recommendations have been implemented and full,
effective use of existing enforcement provisions is achieved.
