Small Scale Renewable Energy (Microgeneration) Permitted Development Rights – Public Consultation Document

The purpose of this consultation is to obtain the views of the public and all interested parties on the provision of permitted development rights (‘PD rights’) for microgeneration (small scale renewable energy) development associated with dwellinghouses and within the curtilage of a dwellinghouse.

PD rights provided by the Planning (General Development) Order (Northern Ireland) 1993 (S.R. 1993. No.278) (the ‘GDO’), allow certain, often minor or non-contentious, types of development to proceed without the need for a planning application, since planning permission for them is deemed to be granted. This helps reduce the number of planning applications and the regulatory burden of the planning system. The exercise of these rights is subject to specific exclusions and conditions.

The Department is committed to reviewing existing householder PD rights and providing a simplified regulatory regime for microgeneration development that will facilitate such development. Existing PD rights mostly date back to the mid 1990s and were not designed to facilitate microgeneration development. Their application to microgeneration development can be uncertain.

To assist the reader, the Department has produced a policy document a 'Review of Permitted Development Rights for Small Scale Renewable Energy Development', as a companion reference to the consultation document. Together the documents consider the issues, options, impacts and constraints relating to each of the main microgeneration technologies and invite responses to a range of questions.
